A Guide On Partner Visas

The Australian partner visa enables de-facto partners and spouses of Australian citizens and permanent residents to live, work and study in Australia. If you intend to apply for this visa, read the excerpt below for a few pointers. 

Permanent Or Temporary Visa

The offshore (one applied by applicants who are not in Australia) and onshore (one applied by people in the country) partner visas can either be permanent or temporary. As a first-time applicant, you should apply for a temporary visa. However, you can apply for a permanent visa that makes you a permanent Australian resident. People with permanent visas are eligible to apply for Australian citizenship. 

Eligibility Criteria

You must meet strict character and health requirements. Additionally, you should be in a legal, genuine, and continuing relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. Typically, you cannot apply for a partner visa if your union is not recognised in Australia. For instance, say you are married to your relative or are in a polygamous marriage. 

Your sponsor should be your spouse or de-facto partner. They should not have sponsored someone else on a similar visa within the last five years. The department requires a police clearance certificate to ensure that your sponsor is a law-abiding citizen. They must be willing to support your stay while in the country. 

Documentation

The department requires you to submit your identification and personal documents when applying for the visa. Besides, you must submit evidence to prove the following: 

  • The financial aspects of your union. You will need to show that you own joint property, bank accounts, or money transfers to either party.
  • The social aspects of your union. For instance, have you met your spouse's family? What activities do you enjoy together? Do you share friends?
  • The nature of your household. For instance, how do you share responsibilities? Will you be living together?
  • The nature of your commitment. Typically, the department will want to know how well you are aware of your spouse or partner. For instance, what is their background? What are their goals? Are you in regular contact at all times? 

Once you make an application, the department might request an interview as part of the application follow-up process. If possible, ask your immigration lawyer to accompany you to this interview. 

Successful applicants must observe the conditions of their visas. Typically, you are required to be a law-abiding individual while living in the country. Your visa could be cancelled if you engage in criminal activities.
